CESR summary on administrative measures on MAD




CESR issued an executive summary to the report on administrative measures and sanctions as well as the criminal sanctions available in Member States under the Market Abuse Directive. CESR seeks to develop a common understanding amongst its members regarding treatment of aspects of the Market Abuse Directive and therefore identified work topics that merit further guidance to achieve greater convergence in the application of the MAD.

 

CESR also provides technical assistance to the European Commission on the MAD legal framework when specifically mandated to do so.

 

CESR was asked by the European Commission in March 2007 to assist in setting up, for information purposes, a list of administrative measures and sanctions as well as criminal sanctions under the MAD in Member States, in order to facilitate greater transparency in the application of the MAD and thus to facilitate effective implementation and application of the MAD.
