CESR call for evidence on eligible assets of UCITS

CESR launched a call for evidence to clarify definitions concerning eligible assets for investments of UCITS. The advice includes among others advice on the factors to be used to determine under which conditions other investment funds than UCITS fall within the scope of the definition of “other collective investment undertaking”, the eligibility of certain categories of money market instruments dealt in on a regulated market, and under what conditions a derivative financial instrument falls within the scope of the definition of derivative financial instruments.

A public consultation on the draft guidelines proposed by CESR is expected to be published in the first half of 2005. A public hearing might be held in May.
The deadline for consultation is 28 November 2004.
