FESCO report on Market Abuse: Measures to promote Market Integrity

Under the terms of the EU’s Action Plan for Financial Services, FESCO submitted a first paper to the Commission setting out the regulator’s view of the key elements of an effective EU regime against market abuse.. The prime concern in regulating market abuse is the public interest in maintaining the integrity of markets and protecting them from the damage that can be caused by market manipulation or misuse of information.
In accordance with the group's mandate, the focus of this second paper is primarily on methods of implementation of preventative measures outlined in chapter D. of the above mentioned FESCO paper (see Annex 1). These measures, which are aimed at promoting market integrity, were an innovative pillar in FESCO’s approach to fighting market abuse in the EU. The members of FESCO therefore deemed it necessary to further develop FESCO’s approach in this area. It is on the detail of this approach that FESCO is seeking comments from participants in the market.
