El País: A growing row between Gibraltar and the EU

02 March 2018

Following the EU's publication of its draft withdrawal agreement, El País reports Gibraltar wants to take legal actions if the region is marginalised in the transition agreement of the Brexit negotiations.

In the draft agreement, the Commission states that the territorial scope of the agreement, including any transition arrangement, will depend on the UK settling various disputes with EU27 countries, “notably as regards Gibraltar”. While this means an Anglo-Spanish agreement is necessary for Gibraltar to be covered by the exit terms, the EU gave Spain the right to veto the application of the transition agreement to Gibraltar. Gibraltar, which strongly voted remain in the referendum, defends its right to be covered by the same transition and withdrawal period and claims a possible exclusion would be a form of legal and political discrimination.
