This new agreement ensures that, after Brexit, financial supervision and market conduct supervision over those companies that no longer write new business in the host country will continue to be shared between authorities in the same way as before during the transitional period of 21 months.
"The position of policyholders should not be worsened by Brexit” explains BaFin Chief Executive Director Dr Frank Grund. "The agreement between BaFin and the PRA ensures that we will be able to cooperate with the UK authorities just as we did before."
BaFin’s handling of complaints is also to continue in the same way as before. For example, BaFin will accept and handle complaints regarding insurers domiciled in the United Kingdom that have concluded insurance contracts in Germany; in the reverse case, where complaints are received regarding German insurers that have concluded contracts in the United Kingdom, BaFin will handle the complaints to the extent possible within the legal framework.
