The ESC points out that the text of the proposal raises a number of important questions in various fields. Without wishing, however, to call into question in every case the aims of the provisions concerned, attention should be drawn to the problems which will face all of the parties which have to apply the Directive and, in particular, the paying agents. Next to a number of other issues the Committee claims that an initial problem of this type concerns income from undertakings for collective investment (UCITS) which have themselves invested at least 15% (40% during the transitional period) of their assets in debt-claims.
